The offence of sexual exploitation, as defined in section 153 of the Criminal Code, occurs when a person in a position of authority or trust towards a young person engages in sexual activity with the young person, even if there is apparent consent.
Sexual exploitation is a hybrid offence. This means that the Crown can choose to proceed with the charge either by indictment or by summary conviction. If convicted following an indictable proceeding, you may face more severe penalties than if the matter proceeds by summary conviction.
